If employees or customers interact with Claude directly (customer-facing chatbot, employee assistant), consider whether conversation logs are retained and how they'd be retrieved in response to a Subject Access Request.
For internal deployments where employees submit data on behalf of the company, the right of access applies to employees as data subjects — they can request access to their own conversation logs if you retain them. Implement a process to retrieve logs by user identity if you retain conversation data.
Right to Erasure (Article 17)
The "right to be forgotten" is complex for AI systems. For Claude API customers, Anthropic does not retain conversation history by default — each API call is stateless. If you store conversation logs in your own systems, you need a process to delete personal data on erasure requests.
Critically: if personal data has been used in fine-tuning a custom Claude model (if you've done custom training), erasure of data used in training is extremely difficult — near impossible with current technology. Avoid fine-tuning on data that includes personal data unless you've established a clear legal basis and can manage erasure risk.

Consider how you'd handle an employee objecting to having their work processed by Claude. Under GDPR Articles 13 and 14, individuals must be informed about processing of their personal data. Update your employee privacy notice and customer privacy policy to cover Claude processing. Key disclosures include: that you use Claude as an AI tool, what data may be shared with Claude, the legal basis, data retention periods, and the international transfer mechanism to Anthropic.
Employee Monitoring Considerations
If you retain logs of employee Claude conversations for quality, training, or audit purposes, this constitutes monitoring of employee activity. EU data protection law imposes strict requirements on employee monitoring:
- Transparency: Employees must be clearly informed that their Claude conversations may be logged and reviewed. Include this in your acceptable use policy and repeat it clearly in any Claude interface your employees use.
- Proportionality: Log retention should be limited to what's necessary. Define retention periods (30 or 90 days is common) and apply automatic deletion.
